3M knew that the Combat Arms Ear Plugs were defective.
3M Company sold dual-ended Combat Arms Ear Plugs, Version 2 (CAEv2) to the United States military without disclosing product defects that affected the effectiveness of the hearing protection device.
How are the Combat Arms Earplugs defective?
The Combat Arms Ear Plugs were too short for proper insertion into the user’s ears causing the ear plugs to loosen, allowing sound in, and thus, not protecting the user’s ears. 3M failed to disclose and warn of the product defect to the military.
Because 3M knew about the ear plugs' product defects and failed to disclose and warn of the defects, 3M agreed to pay $9.1 million to the United States Military. The settlement was reached as a result of the allegations made under the False Claims act.
